Mari,

My understanding of this is it simply has to do with the case of State
or Local Agencies needing to run through someone's private property
with a roadway or utility easement so it could become a public
right-of-way for the expansion or addition of a street plan or utility
route map for a new or existing residential subdivision, but not in
the case of the State Highway System.

In the case of  the Evergreen Avenue Sidewalk Plans, there's no
description of fences being moved in the plans to achive the new
sidewalk installation.

The sidewalk addition is noted on the proposed plans to be in the
right-of-way within the county easement.

(I'm open for comments!)

An Office Bulletin has been posted to the Local Assistance website
DLA-OB 10-15 - Deletion of Exhibit 13-A "No Right of Way
Certification.

Change:
In the past, Exhibit 13-A "No Right of Way Certification Local
Assistance Project (Off the State Highway System)" of the Local
Assistance Procedures Manual (LAPM) was used for local assistance
projects where no additional right of way, rights in real property,
or utility relocations of any kind were required. The "No Right of
Way Certification" was completed by the local agency and approved
by the District Local Assistance Engineer without District or
headquarters Right of Way staff review or approval.

Effective December 1, 2010, Exhibit 13-A will no longer be used by
the local agency or accepted by Caltrans from local agencies.
Exhibit 13-B must be used for all right of way certifications,
including those cases where Exhibit 13-A (now being deleted) was
used in the past. Exhibit 13-B requires Caltrans District Right of
Way staff review and action.

Impacts:
This policy impacts all Federal-aid local assistance projects where
no additional or additional right of way, rights in real property,
or utility relocations of any kind are required or may be required.
LAPM Exhibit 13-A and its related language are deleted from the
LAPM in their entirety.
